Terms of Service

1. The service

SparkGPT ("we", "us") provides a platform for building, training and deploying AI sales agents on your website ("the Service"), available at sparkgpt.ai. By creating an account or using the Service you agree to these Terms.

2. Accounts

You are responsible for your account credentials and for all activity under your account. You must provide accurate information and be authorized to act for the business you register.

3. Plans and billing

• Free plan: build and test one agent at no cost. Live deployment is not included.
• Growth plan: $2.99 per month plus a 5% commission on sales attributed to your agent (a purchase made within 30 days after the buyer chatted with your agent). The monthly fee and commissions are both paid from your prepaid credit balance (1 credit = 1 USD): the plan starts with a top-up of at least $10, the first month's fee is deducted the same day, and each later month's fee is deducted on your renewal date. Commission is calculated on the products in the order after discounts, excluding shipping and tax.
• Shopify App: free to install; the 5% commission on attributed sales is billed through your Shopify invoice, subject to the usage cap you control in Shopify admin.

If your balance cannot cover the monthly fee on your renewal date, nothing is charged and your agents pause until you top up; we email you 7 days and 1 day before. During a paid month, commission may take your balance below zero by up to $20, which is settled from your next top-up; beyond that your agents pause. If an attributed order is refunded or cancelled, its commission is returned to your balance. We never charge your card without an action you initiated (a top-up).

4. Acceptable use

You may not use the Service to publish unlawful, deceptive or harmful content, to infringe third-party rights, or to attempt to disrupt the Service. Agents answer on your behalf; you are responsible for the accuracy of the business information you train them with.

5. AI output disclaimer

Agent responses are generated by artificial intelligence and may contain errors. Review your agent's configuration and training before going live. The Service is provided "as is" without warranties of uninterrupted or error-free operation.

6. Termination

You may cancel at any time; paid periods already started are not refunded except as described in the Refund Policy. We may suspend accounts that violate these Terms.

7. Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of the Service is limited to the amounts you paid us in the three months before the claim arose.

8. Changes

We may update these Terms; material changes will be announced on this page. Continued use after changes take effect constitutes acceptance.
